When you purchase goods from New Designer Leather Goods, you benefit from both statutory guarantees and any commercial warranties we offer. Under EU law (Directive (EU) 2019/771), you have a minimum two‑year right to have faulty goods brought into conformity at no cost, regardless of whether you bought online or in‑store. If a product turns out defective, you may request repair, replacement, price reduction, or a refund—free of charge—and defects within six months are presumed to have existed at delivery. Beyond the statutory guarantee, any optional commercial warranty you purchase provides additional protection and must be documented in a durable medium with clear coverage, duration, and claim procedures.
1. Statutory Guarantee (Conformity)
Under Directive (EU) 2019/771, you are always entitled to a minimum two‑year guarantee at no cost on all goods purchased in the EU, Norway, or Iceland. This statutory guarantee means that, if goods are not of the agreed quality, description, or performance, M Leather must, at our choice:
- Repair the goods
- Replace the goods
- Reduce the price proportionately
- Terminate the contract and refund you
2. Remedies for Defective Goods
If you buy goods in Europe and they turn out to be faulty or do not look or work as advertised, a seller must repair or replace them, reduce the price, or give you a refund.
- Initial Remedies: We will first offer a free repair or replacement. If that fails to resolve the defect, you may then choose a full refund or a price reduction.
- Minor Defects: If a defect is only minor, a price reduction may be more appropriate than a full termination.
- Free of Charge: All necessary costs for bringing goods into conformity—including postage, labour, and materials—are covered by M Leather at no extra cost to you.
3. Burden of Proof
If a fault appears within six months of purchase, it is presumed to have existed at the time of purchase. For defects emerging after six months (but within two years), you may need to show the fault was not due to normal wear or misuse.
4. Obligation to Notify
You must inform us of any lack of conformity within at least two months of discovering it. We recommend you notify us as soon as possible to ensure smooth processing of your claim.
5. Commercial Warranty (Optional)
A guarantee or warranty is an undertaking by a seller or manufacturer to the consumer to reimburse the price paid, replace or repair the product, or proceed in the manner set out in the guarantee statement during the period specified.
- Coverage & Duration: Any additional warranty you purchase covers defects beyond the two‑year statutory period.
- Fee & Activation: Commercial warranties are optional and may require a separate fee or registration.
- Relation to Statutory Guarantee: These warranties are in addition to your legal rights and do not replace them.
6. Warranty Documentation Requirements
All statutory guarantees and commercial warranties are provided in a durable medium and clearly state:
- What is covered
- Exact guarantee/warranty period
- Geographical restrictions (if any)
- Activation or registration procedure (if required)
- Procedure for making a claim
- Who is responsible (seller, manufacturer, or third‑party)
